These Terms set the rules for using this website and related online services. Advantage Boat Center offers these Online Services for some or all of its locations. "Online Services" include our pages, forms, portals, booking tools, account areas, payment pages, access features, and communication tools. Additional terms may apply when you rent, buy, enroll, pay for, or use a service. By using the Online Services, you accept these Terms. If you do not agree, please stop using them.

About these Terms

"We," "us," and "our" refer to Advantage Boat Center. "You" refers to the person or organization using the Online Services. Some provisions apply only when a particular feature is available or a particular law applies to you.

How this fits with our Privacy Policy

These Terms cover the rules for using the Online Services. Our Privacy Policy explains how we handle personal information. If the two conflict on a privacy matter, the Privacy Policy generally controls, to the extent the law allows. Where a separate notice or applicable law gives you stronger protections, that notice or law controls.

Using the Online Services

• You must use the Online Services lawfully and as intended. If you act on behalf of a business, you must have authority to bind it.
• Information on this website, such as descriptions, prices, availability, hours, and policies, is provided for convenience and may change. It is not a binding offer or commitment unless confirmed through a transaction flow or written agreement.
• We may change or remove content, perform maintenance, or limit or suspend access for security, fraud prevention, legal compliance, or to protect property and people.

Transactions, payments, and other services

• Transaction flows identify the service, price, fees, and other key details.
• Submitting a request does not mean we have accepted it. Acceptance occurs only through a confirmation, agreement, checkout, or other written terms.
• Specific services may have their own terms covering eligibility, rates, deposits, cancellations, refunds, late payments, and rules.
• When you pay, you must provide accurate billing details and authorize the charges shown. A third-party payment provider may process payments under its own terms and privacy notice.
• Fees, taxes, deposits, recurring charges, and refunds follow the applicable agreement. To cancel or request a refund, contact us directly. Submitting a request does not guarantee approval.
• If these Terms conflict with a more specific agreement or rule, the more specific document controls.

Accounts and access

• Some features require an account, login credentials, an access code, or a mobile number. You must provide accurate information and protect your credentials.
• You are responsible for all activity under your account or credentials.
• Notify us promptly if you suspect unauthorized use. Do not share access codes with unauthorized people or bypass gates, locks, cameras, or other security measures.

Your responsibilities

• Follow these Terms, any applicable agreements, and the law.
• Provide accurate, complete, and non-misleading information, and keep it current.
• Use the Online Services only for their intended purposes and with proper permissions.
• Respect the privacy, property, and legal rights of others.
• Do not engage in fraud, harassment, impersonation, unauthorized access, distribution of malicious code, attempts to defeat security, use of bots or scrapers without our written permission, unauthorized copying or commercial use, or sharing content you do not have the rights to share.

Text messages, cookies, and communications

• If you opt in to text messages, we may use your mobile number and messaging details to send service updates, reservation information, payment reminders, access information, or support messages.
• We do not share SMS or mobile information, including your mobile number and opt-in or consent records, with third parties or affiliates for their own purposes. We share it only with providers that deliver the messages you requested, or when required by law.
• Marketing texts require separate consent, which you may withdraw using the instructions provided. Reply "STOP" to opt out or "HELP" for help. Message and data rates may apply. Agreeing to receive marketing texts is not required to buy any service.
• We may use cookies and similar tools. Our Privacy Policy explains these tools and your choices. Where the law requires consent for non-essential tools, we ask first.

Reviews, messages, and other content

• You keep ownership of content you submit ("User Content"). You grant us and our providers a perpetual, royalty-free license to host, use, display, and improve it as needed to operate the Online Services.
• You are responsible for your User Content. It must not be unlawful, false, abusive, threatening, discriminatory, invasive of privacy, infringing, or otherwise harmful, and it must not include other people's information without authorization.
• We may remove or limit User Content to protect people or property, operate the Online Services, comply with the law, or enforce these Terms.

Third-party services and links

The Online Services may link to or work with third-party providers, such as payment, booking, tenant portal, access, mapping, social media, analytics, form, and communication services. Those providers have their own terms and privacy notices, which you should review. Your use of their services is governed by your agreement with them.

Automated tools, children, and regional terms

• Automated tools, including artificial intelligence, may support our operations, support request routing, usage analysis, and fraud detection. Our Privacy Policy describes related personal information practices.
• The Online Services are not intended for children under 16, and we do not knowingly collect their information unless the law allows it with any required consent. Where local law sets a different age or adds protections, we aim to follow it.

Content and intellectual property

• We or our licensors own the website content, text, graphics, logos, photos, videos, trademarks, software, and other materials, except User Content and third-party materials.
• You receive a limited, personal, revocable, nonexclusive right to use the Online Services for their intended purposes. No ownership of our intellectual property transfers to you.
• We may use any feedback you send us without restriction or payment, unless the law provides otherwise.

Changes to these Terms

We may update these Terms as our services, business, or legal requirements change. Updates take effect when posted unless the law requires a different date. Continued use of the Online Services after an update means the updated Terms apply going forward. If you disagree, stop using the Online Services and contact us about any active transaction or account.

Transaction-specific terms

These Terms are a general baseline. A transaction, service, account, or feature may have its own agreement with different or additional terms, which may cover cancellations, refunds, access, notices, governing law, dispute resolution, liability, warranties, and indemnity. If these Terms and a transaction document cannot reasonably be read together, the transaction document controls.

Other important information

• If any part of these Terms is unenforceable, the remaining parts still apply to the extent permitted by law.
• Our failure to enforce a provision right away does not waive our right to enforce it later.
• These Terms do not replace service-specific agreements. Where a conflict cannot reasonably be reconciled, the transaction-specific document controls.
